2026 checklist: the 7 legal requirements for your short-term rental (2-minute test)

The 7 points that get checked

If you rent out a short-term property in Spain, this is what typically gets checked — whether by a platform, your regional government, or the tax authority:

  1. Regional tourist registration. The one required by your autonomous community (not the single state registry, which was struck down by the Supreme Court — we explain it here).
  2. Declared rental type. Full tourist home, rooms, or seasonal (over 31 days) — each one is treated differently.
  3. Registration number visible on your listings. Platforms can remove listings without it (read the Airbnb case).
  4. SES.Hospedajes. Registering your guests within 24 hours of arrival.
  5. Modelo 179 / income declaration. Platforms already report your income to the tax authority, so declaring it is no longer optional in practice.
  6. Homeowners' association (comunidad de propietarios). If your building has expressly banned tourist use, that's also relevant to your legal situation.
  7. Municipality. Some large cities have additional, municipality-specific conditions.
